Request is hereby made for the season for a mooring in the Sachem’s Head mooring field located at Sachem's Head in Guilford, CT, by the Owner/Lessee named above, an individual residing in the Sachem’s Head Association and/or a member of the Sachem’s Head Yacht Club.
II. Rent and Fees.
Boat Owner shall pay for the lease of said mooring for the 2025 season, use commencing at such time as the mooring is ready for use in the spring and continuing until closing day of the Club,
III. Terms and Conditions of Use of the Mooring.
Boat Owner shall ensure that his boat is safely moored at all times with lines, chain, tackle, and chafe gear adequate for weather conditions and shall immediately notify the club of the necessity of repairs to the leased mooring. Boat Owner shall not move alter or sublease the mooring without written permission of the club or the Harbor Manager appointed by the Sachem’s Head Harbor Management Commission (Commission) or his assistants.
IV. Boat Owner's Liability; Indemnity of the Club and the Sachem’s Head Harbor Management Commission
Boat owner shall submit proof of registration and insurance as part of this application. Further boat owner and his representatives including insurers shall indemnify the Club and any Harbor Manager appointed by the Commission against all claims, actions, proceedings, damages and liabilities, including attorney's fees, arising from or connected with Boat Owner's possession and use of the mooring, the mooring location, or Sachem's Head Harbor. Boat owner agrees to require insurer to waive any claims by way of subrogation against the Club and/or Harbormaster
V. Limitation of Club's Liability.
Boat Owner acknowledges that he/she will inspect the mooring and mooring location leased herein to be satisfied that the mooring is adequate for safe mooring of the vessel. Contract is not a bailment of Boat Owner's boat but a lease of a mooring and mooring space, and the Club's liability and the liability of any Harbor Manager appointed by the Sachem’s Head Harbor Management Commission (Commission) or the Harbor Manager’s Assistants, either volunteer or paid, is limited to making reasonable efforts to contact the Boat Owner and notify him of any dangerous conditions known to the Club or the Commission’s Harbor Manager that require the Boat Owner's attention; but neither the Club nor any Harbor Manager appointed by the Commission assumes any responsibility for tending moorings, mooring spaces or mooring lines, chains or tackle; or for moving boats from moorings to which they are assigned.
I understand that all of Long Island Sound is a Federal No Discharge Zone, and that my vessel must be properly registered in Connecticut or be documented with a Connecticut Certificate Decal in order to obtain a mooring space.
