FERRY ROAD DOCK RULES AND REGULATIONS
1.The Town of Old Saybrook will accept applications for mooring slip space at the Ferry Road Dock in the following order of preference:
a. Any Old Saybrook resident or taxpayer who holds a Connecticut commercial fishing license and who depends on this license for a livelihood as demonstrated by a Connecticut Fisherman Tax Exemption Permit. A Connecticut Fisherman Tax Exemption Permit must be presented yearly to be given higher priority than other Saybrook residents and taxpayers;
b. Any Old Saybrook resident or taxpayer;
c. Any non-resident.
d. Applications will be accepted on a first-come first-served basis in the above order of priority.
2.Slip rentals are non-transferrable. Only a boat assigned to a slip is to be moored in that slip. Slips are to be used only for mooring.
3.The Town of Old Saybrook, or any of its agencies, assumes no responsibility for the safety of any vessel docked at the Ferry Road dock facility and will not be liable for fire, theft, or damage to said vessel, its equipment, or any property in or on said vessel, however arising.
4.The tenant agrees that any grant of storage space shall constitute a rental of space only and no bailment of any kind is intended or created, either expressed or implied.
5.Slip tenants will be held responsible for damage they cause to structures, pilings, or other boats.
6.All boats in leased slips at the Ferry Road dock will be registered, identified, marked, equipped, and maintained as required by law and safe practice.
7.Slip tenants will not store supplies, materials, accessories, fishing gear, or debris on the dock.
8.Section 15-8 of the General Statutes of Connecticut prohibits discharge or deposit of any rubbish, waste material, or refuse material of any kind or description into the waters of any river, stream, pond, or tidal waters. Penalty: $1,000 fine or imprisonment of (3) months or both. All garbage and refuse must be placed in receptacles provided by the Town of Old Saybrook.
9.It is the slip tenant’s responsibility to provide general liability insurance with a minimum coverage limit of $300,000 for his or her vessel. Failure to maintain insurance coverage will be grounds for loss of mooring privileges.
10.Slips may be occupied April 1 through December 30.
11.Slips must be occupied by the tenant’s listed vessel at least 50% of the time between June 20 and September 20. Exemptions to Rule 11 must be arranged in advance, in writing to the HMC at 302 Main Street, Old Saybrook, CT 06475 or oshmcclerk@oldsaybrookct.gov.
12.All slip tenants shall be limited to one slip unless a slip tenant has a current Connecticut Fisherman Tax Emption Permit, is an Old Saybrook resident, and has previously been allowed two slips.
13. Slip tenants may moor more than one boat in the assigned slip provided those boats are owned by the slip tenant, the boats are listed on the slip application and the slip tenant holds a commercial fishing license. Under no circumstance shall the slip owner be entitled to occupy two slips at the same time except as allowed in Rule 12.
14. The Town of Old Saybrook has the first right of refusal on all slips on the floating piers, which needs to be exercised before slips are renewed. If the Town of Old Saybrook exercises this right, slips shall be released by existing slip holders in reverse order of when the slips were granted. Newer slip holders will release their slips first.
15. Any infraction of the above rules and regulations of the Town of Old Saybrook by the tenant shall, at the option of the Town of Old Saybrook, cancel this contract upon 10 days’ notice, and the tenant shall forthwith remove his or her boat.
